Welcome to Finico!

These are Finico's terms of use. By using Finico, you agree to the terms on this page. Since terms are sometimes a bit tough to get through, you'll see a highlighted summary at the beginning of every section. These summaries give you a short version of the terms, but they are not legally binding. If we change these terms, we will always tell you.

Finico OÜ. is an Estonian entity located at Narva mnt 5, Tallinn, Harjumaa, Postal Code 10117 in Estonia. Finico is currently developing a trading platform for cryptocurrencies. These are Finico's terms (referred to below as "the terms") and form a binding legal aggrement between you and Finico and apply to all users of the Finico Website. “We,” “our” or “us” refers to Finico OÜ, collectively, “Finico”. The use of “Finico” in these terms refers to this website and the services we offer.

By using Finico you agree to these terms.

You acknowledge that you have read and understood these terms. You also agree to our Privacy Policy. We may change these terms from time to time. In case of changes that affect your rights we are going to inform you by posting an announcement on our site or sending you an email. If you continue to use Finico after a change, you accept our new terms.

Account Creation

To register for an account, you must be at least 13 years old. To pay money, there are other requirements. You are responsible for your account.

When you register for an account the information you give us has to be accurate and complete. If the information you give us is not accurate it might be impossible for us to help you with accessing your account. We may cancel your account if you break these rules.

To register for an account you need to be at least 13 years old. To give pledges you have to be old enough to form a binding contract where you live or have your parent's permission.

You are responsible for all the activity on your account, as well as the security of the account. If you believe that someone used your account without your permission, you must report it to support@finico.tech immediately.

User Conduct

Be responsible and don't do bad stuff.

If you do bad stuff we may cancel your account. Bad stuff includes:

  1. Illegal Activities - Don’t break the law or encourage others to break the law.
  2. Impersonation - Don’t impersonate anyone. Don’t use another's account, or allow others to use your account.
  3. Service Degradation - Don’t degrade others’ use of Finico.

We may post guidelines to further specify good and bad behaviour. If you hurt Finico or our users in any way we may take action to prevent it.

Supporting Us

We promise to use your pledges to create the Finico trading platform.

You can support us in many ways. For starters, we really appreciate if you read about us, our services and our news.

To support us financially simply create an account and pledge to us. We promise to use the pledges for the development of Finico and the services we offer.

We promise to do our best to build a successful trading platform, to be honest and transparent in our communication and to talk about our mistakes as well as our fulfilled goals. At the same time, you must understand that when you support us financially, you're helping us to create something new – not ordering something that already exists. There may be changes or delays, and there's a chance something could happen that prevents us from being able to create the trading platform as promised.

We may grant refunds at our sole discretion in exceptional circumstances.

Account Disabling

You can disable your account by sending us an email. We can disable your account at our discretion.

You can permanently disable your account by sending an email to disable@finico.tech. In our privacy policy you can see what information is deleted and what we continue to store after your account is disabled.

We reserve the right to terminate or suspend your account at any time at our discretion.

These terms remain in effect after your account is disabled.

Finico’s Content

Make sure you have permission when using our content.

Our content (including the text on the website, our logo, and our codebase) is protected by copyright, trademark and trade secret laws.

You may not otherwise use, reproduce, distribute, perform, publicly display or prepare derivative works of our content unless we give you permission in writing. Please ask if you have any questions.

Indemnity

If we are sued because of you, you have to help defend us.

You will indemnify Finico and our affiliates, officers, directors, employees, agents and third party service providers from all liabilities, claims and expenses, including legal costs, that arise from or relate to your use or misuse of Finico. We reserve the right to exclusive defence and control of any matter covered by this clause, in which case you will help us in our defence.

Warranty Disclaimer

We work hard to offer great services, but stuff happens.

You use Finico solely at your own risk. Finico is provided “as is” and "as available" and without warranty of any kind. Finico disclaims to the greatest extent permitted by law any warranty of merchantability, non-infringement, and fitness for a particular purpose.

Limit of Liability

If you lose money as a result of using Finico, we're not liable.

To the extent permitted by law, in no event Finico and its affiliates, officers, directors, employees, agents and third party service providers are liable to you for any incidental, consequential or punitive damages arising out of these terms, or your use, attempted use or inability to access Finico.

Dispute Resolution

If you have an issue please contact us before resorting to the courts.

If you’re having an issue, we encourage you to contact us (legal@finico.tech) before resorting to the courts. You can use the EU Online Dispute Resolution Platform.

If you live in the EU, you can submit your complaint via the EU Online Dispute Resolution Platform (http://ec.europa.eu/odr).

Governing Law

Any disputes with us must be handled in Estonia under Estonian law.

Estonian law, excluding its conflict of law provisions, governs these terms and all other Finico policies. Both parties agree that the courts located in Tallinn, Estonia shall have exclusive jurisdiction and venue in case of a lawsuit.

Everything Else

These terms are the final word on Finico’s policies. Thank you very much for reading them, and for using Finico!

These terms and all referenced policies constitute the entire agreement between you and Finico. The actual terms are a substitution of all prior agreements.

If any provision of these terms is found to be invalid under the law, that provision is modified to the minimum extent necessary to enforce it. If it is not possible to modify a provision, it is severed from these terms, but all other parts of these terms remain in force.

If you or Finico fails to enforce a right provided by these terms, it does not waive the enforcement of any rights in the future.
